Terms and Conditions

PART A– DEFINITIONS
In the contract the following expressions have the meaning given to them below :-
THE COMPANY– Whites CCTV & EPOS Solutions
THE SUBSCRIBER— Person or body who accepts to purchase the installation and maintenance of the system from the company.
THE SYSTEM—The whole installation, user access passwords, remote access via mobile devices, wiring, equipment and maintenance of the system offered for sale by the company to the
Subscriber.
THE OFFER—Quotation, specification, and other supporting literature offered by the company to the subscriber for the purchase price of the installation and maintenance of the system.
ACCEPTANCE—The acceptance by the subscriber of the quotation document provided for the purchase of  the installation and
Maintenance of the system under contract for a minimum of 12 months after  the warranty period expires. This quotation shall become a contract when signed by the subscriber or when the company begins installation for the subscriber.
WARRANTY—The company guarantees  its workmanship ,materials and equipment for a period of 12 months from completion  of the system and carries out warranty repairs within that period at no additional charge.
COMPLETION DATE– The date on which the original  installation of the system shall have been Whites by the company.
MAINTENANCE/CONTRACT– A contract between the company and the subscriber for the maintenance and servicing of the system renewable every twelve months. This contract subsists for an initial minimum period of three years unless previously terminated in accordance with the conditions stated herein. Not less than three months’ notice in writing shall be given by either party to terminate.
PART B—SUBSCRIBER’S OBLIGATIONS
The subscriber
CONSENT AND ACCESS—shall obtain and pay for all necessary consents for the installation of the system and shall give the company unimpeded access to the installation address at all reasonable times for the purpose of carrying out the installation and maintenance of the system in accordance with the contract. The subscriber acknowledges that the company may make extra chages for work carried out outside normal working hours.
CHARGES—Shall reimburse the company for any charges made by the police, service providers or other authority  to the company from time to time in connection to the system.
TELECOM FACILITIES—Shall make and pay for such arrangements with the telecom provider or other authority as may be necessary in connection with the system.
NON—INTERFERENCE WITH THE SYSTEM—Shall not, nor shall the subscriber permit any person to repair or replace or in any way interfere with the system or any part thereof.
DEFECTS—Shall notify the company forthwith any defects appearing in the system and shall permit the company to take such steps as it shall consider necessary to remedy such defects.
ALTERATIONS—Shall notify the company of any structural alterations to the installation address or any modifications in the requirements of the system or in the telephone internet installation affecting the system. The company shall carry out all alterations and
Modifications necessary to maintain the system at the expense of the subscriber.
DAMAGE AND REPAIR TO THE SYSTEM—Shall pay the company for the full cost of all work carried out to the system and equipment due to damage caused by accidents malicious damage interference by a third party acts of god.
RE-SETTING THE EQUIPMENT—Shall pay the full cost of all visits to re-set signalling equipment, re-set passwords, routers, other than those attributed  to equipment failure within the warranty period.
INDENIFICATION –Shall indemnify the company against any loss or damage direct or consequential, caused or contributed to by any defects or failure of the system or by any failure of the communication  by this or any associated system, other than for direct physical loss, direct physical damage or direct physical injury arising from sole negligence of the company or its employees, shall indemnify the company against any claim made by the police or any other person, company or public body in respect of a false call (unless the company
accepts responsibility for the false alarm).
PAYMENTS—Our normal  Terms Of Business are that the system remains the property of the company until full payment is made to the engineer or installer upon completion of the Installation unless credit  terms have been agreed in writing. Any payment codes or passwords will be with held  until full payment is received at such time they will be given to the subscriber. The Company reserve the right where payment is overdue by more than one month to charge interest on any balance outstanding thereafter at 2%  above the current base rate of the Bank of England and to withdraw its services until settlement is received.
PART C—COMPANY OBLIGATIONS
Routine maintenance—Shall carry out routine maintenance during normal working hours in accordance with the relevant standards for the cctv security system and any local requirements referred to in the system specification.
Service—Shall provide a 24 hour emergency phone number by telephoning the number provided to the subscriber by the company.
EMERGENCY VISITS AND REPAIRS—Shall charge the subscriber the labour and travelling costs for all emergency visits and repairs. The cost of replacing materials, equipment password re-sets will not be charged unless under the conditions referred ti in part B section 7.
PART D—COMPANY LIABILITY
The company accepts liability in respect of death or personal injury resulting from negligence of the company or agents when acting in the course of there employment by the company. Direct physical damage to the installation address or its contents to the extent that the same is caused by the negligence of the company, its servants or agents whilst working on the installation for the purpose of this contract but not otherwise; provided that the liability to the company under the sub –clause -( A ) shall be limited to the amount necessary  to make good the damage, and 9 B ) shall not under this contract exceed the total sum of £50,000,00 inclusive of all costs and expenses unless previously
Agreed in writing by all concerned parties.
